Please read these Terms and Conditions carefully. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions. We reserve the right to amend and update these Terms and Conditions at any time without notice.

• Users may not run server processes (eg. talkers/IRC Bots) from your login account. This includes, but is not limited to, installing IRC bots, excessive use of CPU resources or disk space, or CGI scripts that use a large amount of system resources. We will determine what constitutes system abuse.

• NO SPAMMING TOLERATED. We will suspend the account and try to contact you immediately if it appears that a large number of hits are coming from email advertising, so please send us a copy of any legitimate newsletters you circulate.

• No child pornography or other illegal material is allowed.

• No user should give out his/her password to any other person, and all users should take reasonable precautions to make sure that their password is not discovered by other people.

• No user may manipulate or attempt to manipulate our servers or other client's web sites at any time. This includes, but is not limited to, attempting to gain unauthorized access to our servers, deliberately overloading our systems, or using our systems to overload any other system on the Internet.

• Each user will be responsible for the content of his/her pages, which includes ensuring that they do not infringe on any copyright, trademark, or other laws.

• Please note that unless otherwise stated, all custom scripting and installations and setup may be proprietary and non-portable and, by default, payment for such scripts is for non-exclusive right of use. All custom services, scripting and installations and setup remain the property of Frogsmart.com unless the sale or lease of such scripts has been explicitly stated in writing along with the price.

• We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.

• We reserve the right to cancel any user's account at any time without notice. No refunds will be given for accounts canceled due to violation of our policy or the law. We will, at our sole discretion, determine what constitutes a violation of our policy.

• When a user's account is closed, we reserve the right to delete all files (including web pages, etc.) without notice.

• We make no guarantees of backing up data stored on our servers. We recommend that you keep an independent backup of important data.

• We are not responsible for any direct or consequential damages, but will give a prorated refund for any actual prolong outage, just as long as that outage is reported to us within seven days of its occurrence.

• Setup and hosting-related fees are required before service is activated. Setup fees are non-refundable. A $29 fee will be assessed for any returned checks. Registration of one available .com, .net, .org is included in the setup fee. If a user does not choose to register a domain name, the setup fee will be credited, upon request, on the 11th and 12th month of hosting.

• Multi-domain / signpost accounts come with support for three domain names. Support for extra pointer domains costs $1.50/domain/month and $2.50/domain for setup. This cost does not include the price of the domain name.

• Domains registered through Frogsmart.com cost $25/year as of this writing. However, as prices may vary, please contact us for more information. Domain names may also be registered through any third party.

• Our economy, personal, business, and multi-domain accounts include 2 GB of bandwidth and 100 MB of storage space. Extra bandwidth costs $0.02/ MB and extra storage costs $0.05/ MB.

• Custom accounts, by nature, may vary from one account to another or from one customer to another. Storage, bandwidth and other terms and conditions including limits on bandwidth, storage and additional domains may vary with each custom account. • We are not responsible for any typographical errors in this offer, so be sure to contact us directly at hosting@frogsmart.com if you have any further questions.

• Fraudulent chargebacks and larceny by check will not be tolerated.
